These Terms of Service (“Terms”) govern your access to and use of the Anytime Trivia service (“Service”), provided by Anytime Trivia, LLC (“Anytime Trivia,” “we,” “us,” or “our”).
By purchasing, installing, accessing, or using the Service in any way, you agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use the Service.
These Terms apply to all customers, venues, and users of the Service.
1. Description of the Service
Anytime Trivia is a subscription-based trivia system designed for bars, restaurants, and similar venues. The Service includes access to trivia content displayed on venue TVs, player participation via QR code on personal devices, and a physical plug-and-play device provided as part of the setup fee.
2. License to Use the Service
Subject to your compliance with these Terms, Anytime Trivia grants you a limited, non-exclusive, non-transferable, revocable license to use the Service solely within your venue for internal business purposes.
You may not copy, reproduce, distribute, resell, sublicense, or otherwise exploit any part of the Service, including trivia content, software, or hardware, except as expressly permitted by these Terms.
3. Hardware Use & Ownership
The physical device provided with the Service remains the property of Anytime Trivia unless otherwise stated in writing.
You agree to:

Use the device only in connection with the Anytime Trivia Service

Not modify, reverse engineer, or tamper with the device

Return the device if required under these Terms or upon cancellation
Failure to return the device when required may result in additional charges.
4. Subscription & Billing
Access to the Service requires an active subscription.
By subscribing, you authorize Anytime Trivia to charge your selected payment method for:

A one-time setup fee (which includes the device and shipping)

Recurring subscription fees billed monthly as described at purchase
Subscription fees are billed in advance. If payment fails, we may suspend or terminate access to the Service until payment is resolved.
Pricing and subscription terms may change with advance notice. Changes will not apply retroactively.
5. Refund Policy (Hardware-Based Refunds Only)
Refunds are governed by the following rules:
Setup Fee
The setup fee is refundable only if the device is returned in good working condition.
To qualify for a setup fee refund:

The device must be returned within 30 days of cancellation

The device must be functional and not materially damaged

The device must be returned following instructions provided by Anytime Trivia
If the device is not returned, the setup fee is non-refundable.
Subscription Fees
Subscription fees are non-refundable, including:

Partial billing periods

Unused time after cancellation

Promotional or discounted subscription periods
Service will continue through the end of the current billing period after cancellation.
6. Cancellation
You may cancel your subscription at any time through your account or by contacting support.
Upon cancellation:

Subscription access continues through the end of the billing period

You may be required to return the device to qualify for any setup fee refund

No refunds are issued for subscription fees already paid
7. Acceptable Use
You agree not to:

Use the Service for unlawful purposes

Disrupt or interfere with the Service or related systems

Share or redistribute trivia content outside your venue

Attempt to bypass technical limitations or security measures
Any misuse may result in suspension or termination without refund.
8. Intellectual Property
All content, software, trivia questions, designs, and materials associated with the Service are the exclusive property of Anytime Trivia or its licensors.
You acquire no ownership rights by using the Service.
9. Service Availability & Modifications
The Service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
Anytime Trivia may modify, suspend, or discontinue any part of the Service at any time without liability.
10. Limitation of Liability
To the maximum extent permitted by law, Anytime Trivia shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
Our total liability shall not exceed the amount paid by you for the Service during the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Anytime Trivia and its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the state in which Anytime Trivia, LLC is registered, without regard to conflict-of-law principles.
Any disputes shall be resolved in the courts of that jurisdiction unless otherwise required by law.
13. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on our website and take effect immediately upon posting. Continued use of the Service constitutes acceptance of the updated Terms.
